AREEA to seek mining exemption from TASBuild

AREEA will advocate for resources-related work to be exempt from the Tasmanian construction industry’s portable long service leave scheme, TASBuild, as the state government prepares a legislative reform package to clarify its coverage.

TASBuild, a private entity, was tasked by the government in the late 1990s with managing a long service leave fund that allows workers in the building and construction industry to carry their long service leave from job to job.

“The scheme was intended to cover itinerant workers in the construction sector, but a lack of clarity has led to mine employees engaged by contractors being inadvertently covered,” said Bill Fitzgerald, AREEA’s Tasmanian-based principal employee relations consultant.

“AREEA has long contested that, for example, electricians performing maintenance underground should be included in the scheme’s scope. These employees are mining employees and were never within the contemplated scope of the legislation to cover construction employees.”

Mr Fitzgerald said the change would see mining employees’ entitlements fall under the Long Service Leave Act 1976, with employers no longer required contribute to the TASBuild fund.

AREEA will meet with the Minister for Planning and Local Government, Peter Gutwein, and make a submission for the industry’s exclusion from TASBuild.
