AREEA leads charge on Fair Work Commission appeals body

AFTER first raising structural issues and inconsistencies to the general public’s attention, AREEA is continuing the push for a new appeals jurisdiction to be established within the Fair Work Commission (FWC).

This important structural change to Australia’s highest industrial relations tribunal was flagged in the Coalition’s pre-election policy statement and has since been further explored by Employment Minister Eric Abetz.

Last month (21/11), chief executive Steve Knott told AREEA’s Perth mining forum that inconsistent decisions and structural issues meant the Coalition Government should fast-track this new expert appeals body for the FWC.

This public address quickly drew the attention of the Commission and its general manager, who issued a press release implying some of the data quoted by Steve was ‘misleading’.

Last week AREEA set the record straight in an public response outlining its methodology and suggesting the FWC should answer some questions about the ambiguity of its figures and the presentation of its data.

The response also summarises last week’s contentious decision related to port employer DP world, regarding a wharf worker who was eventually found to have been fairly dismissed for assaulting his supervisor.
