Work Choices changes deductions for periods of industrial action

AMMA clarifies for members how the Work Choices legislation requires pay deductions during periods of industrial action to be calculated.



AMMA has clarified that under the Work Choices legislation, employers will be required to deduct a minimum of four hours pay for any time lost due to industrial action regardless of whether the industrial action was actually for a shorter period of time than this. Previously, employers could only deduct the amount of pay for the actual time lost. If more than four hours working time is lost through industrial action, employers are required to deduct the full time lost.  Employees who accept payment for industrial action are now regarded as committing an offence attracting a civil remedy (a fine and/or an injunction).
