New fines for encouraging unmeritorious claims

AMMA advises that the Work Choices legislation provides for fines of up to $10,000 for paid representatives who encourage employees to make unmeritorious unfair dismissal claims.



AMMA advises that under another new provision of the Work Choices legislation, paid representatives who encourage employees to pursue unfair dismissal claims that have no reasonable prospects of success will be subject to fines of up to $10,000. Similarly, employer representatives who encourage employers to defend against claims where they have no reasonable prospect of success will also be subject to fines.
